Court Rejects ULA Motion to Dismiss Orbital Lawsuit Over Rocket Engines

U.S. District Judge Leonie Brinkema has rejected motions from ULA and engine supplier RD-Amross to dismiss an anti-trust lawsuit brought against them by Orbital Sciences Corporation, Space News reports.

Orbital wants Russian RD-180 engines to replace the AJ-26 engines the company uses in its new Antares launch vehicle. However, ULA has exclusive use of the RD-180 engines for its Atlas V rocket through a supplier agreement with RD-Amross, which is a joint venture between United Technologies Corp. and NPO Energomash of Russia.

ULA and RD-Amross asked the court to dismiss the lawsuit, claiming that Orbital has viable alternatives to the AJ-26 engines and that RD-180s cannot be sold to foreign parties without the approval of the Russian government. Thus, Orbital could not prove the $500 to $1.5 million in damages it is seeking over ULA’s monopoly.

ULA and RD Amross LLC have asked the court to dismiss a $1.5 billion lawsuit filed by Orbital Sciences Corporation due to a lack of legal standing, the Denver Business Journal reports.

Orbital wants RD Amross to supply it with Russian RD-180 engines for its new Antares rocket. The company has refused, saying it has an exclusive agreement with ULA to supply these engines for the Atlas V rocket.

Buoyed by two trouble-free launches, Orbital Sciences Corporation is looking to market its new Antares launch vehicle beyond NASA’s commercial cargo program, Spaceflight Now reports.

“With two really good launches under our belt, things are picking up in terms of customer interest,” said David Thompson, Orbital’s chairman and CEO, in a conference call with investment analysts.

“The five-month interval between its first launch in April and its second launch in September gives us confidence both that the overall vehicle design is solid and that we are in a good position to carry out three more Antares launches during the next 12 months,” Thompson said Oct. 17.

Orbital Sues ULA Over RD-180 Engine, Asks for at Least $515 Million

Orbital Sciences Corporation has sued ULA seeking damages of between $515 million to $1.5 billion for blocking sales of the Russian-built RD-180 that Orbital wants to use in its Antares launch vehicle, Space News reports.

Orbital of Dulles, Va., claims Denver-based ULA has not only illegally prevented open-market sale of the RD-180, but also has monopolized the launch-services market for certain satellites in violation of U.S. antitrust laws, according to a complaint filed June 20 with the U.S. District Court for the Eastern District of Virginia in Alexandria.

Space News is quoting Aerojet Rocketdyne President Warren Boley as saying the engine that powers Orbital Sciences Corporation’s new Antares rocket can be put back into production at a reasonable cost, adding an interesting wrinkle to an on-going anti-trust investigation of rival United Launch Alliance.

Antares uses two Aerojet Rocketdyne AJ-26 engines to power its first stage. The AJ-26s are refurbished Soviet-era NK-33 engines built for that nation’s long abandoned manned lunar program. The NK-33 engines are in limited supply because they haven’t been in production for 40 years.

Reuters reports on a FTC investigation of United Launch Alliance for allegedly denying Orbital Sciences the ability to purchase RD-180 engines for the Antares launch vehicle:

The Federal Trade Commission (FTC) is investigating whether United Launch Alliance (ULA), a joint venture of Lockheed Martin Corp and Boeing Co, violated federal antitrust laws by “monopolizing” or restraining competition through an exclusivity agreement with the maker of the engines used in its rockets, according to a FTC document obtained by Reuters on Wednesday.

Soyuz Light Rocket Debut Delayed by Live Test Failure

The inaugural launch of the Soyuz-2-1v rocket has been delayed from this year until sometime in 2013 due to a live test firing failure that damaged the rocket. RussianSpaceWeb.com reports that a planned 200-second firing of the first stage engine failed after only a few seconds, resulting in damage to the propulsion section of the rocket. Russians Move Toward Launch of New Soyuz Light Rocket

Russia is moving steadily toward a planned September launch of the stripped Soyuz 2-1v rocket designed to launch small satellites into orbit. Two tests last month verified key elements of the new rocket, Russian officials say.

On April 19, engineers successfully completed the first cold flow test of the first stage using liquid oxygen and kerosene. The test was done in preparation for the first first-scale test firing of the rocket set for later this year.

The following day, engineers at the United Engine Corporation completed the forth and final test firing of the first stage’s NK-33A engine at the Vintay facility. The company announced that the engine has fired without any problems for 157.5 seconds. The total firing time for the four tests is 600 seconds.
